Terms and Conditions of Sale

Payment: We gladly accept Visa, Mastercard, American Express, Discover and PayPal.

Shipping: All orders are shipped via UPS unless weight or size is prohibitive. Orders shipped to Hawaii, Puerto Rico or Alaska are shipped via UPS .For orders placed on our web site, shipping charges are approximate. The actual shipping charges will appear on the invoice you receive with your order. Please make sure to include a list of the items you want to purchase and your postal (zip) code. Your order will ship via UPS and a discounted shipping charge will be added to your total.

Returns: All sales are final. We will not accept returns on any non-defective goods. Please see below with respect to terms regarding return of defective goods.

Claims: When packages appear damaged on arrival, state condition of the container over your signature on the receipt. If damage is discovered after opening the container, notify the carrier immediately. We provide good merchandise, properly packaged to the carrier. Claims for damage must be directed to the carrier FIRST, not to TUNINGPARTS.

Limited Warranty on New Parts. Except for electrical parts, high performance products and any products already carrying a manufacturer’s warranty (“Excluded Products”), all new parts sold by TUNINGPARTS are warranted against defects in workmanship and material under normal and proper use in their unmodified condition for a period of one (1) month from the date of purchase by the customer ("Warranty Period"). This warranty shall be made only to the purchaser of the parts and shall not be transferable to any secondary purchasers or any other person, and shall not extend to any parts (a) which have been modified by the customer; (b) which have been subject to misuse, abuse, improper handling, improper installation or any other cause beyond that of customary usage; (c) which have not been used in accordance with manufacturer's or TUNINGPARTS’s recommended procedures; and (d) which have been damaged during transport or storage after shipment of the part by TUNINGPARTS. EXCEPT AS SPECIFIED IN THIS WARRANTY, ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS, AND WARRANTIES INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ARISING FROM A COURSE OF DEALING, LAW, USAGE, OR TRADE PRACTICE, ARE HEREBY EXCLUDED TO THE EXTENT ALLOWED BY APPLICABLE LAW. TO THE EXTENT AN IMPLIED WARRANTY OR CONDITION CANNOT BE EXCLUDED, SUCH WARRANTY IS LIMITED IN DURATION TO THE WARRANTY PERIOD. Claims for defective Excluded Products must be directed to the manufacturer of such Excluded Products.

The sole remedy under this warranty to be provided by TUNINGPARTS for parts sold by TUNINGPARTS is replacement free of charge of any such defective part(s), provided however that, customer must notify TUNINGPARTS in writing within ten (10) days of the discovery of any such defect of the full particulars (i.e. part no., end customer, lot no. application) of such defect in materials or workmanship, and shall, upon TUNINGPARTS's request, return such parts to TUNINGPARTS at customer's costs during the Warranty Period. TUNINGPARTS reserves the right to withhold shipment of any replacement part(s) until the defective part has been examined and tested. TUNINGPARTS is not responsible for shipping costs on items returned under this limited warranty. With regard to all warranty claims, TUNINGPARTS is not responsible for labor charges due to incorrect installation or faulty or defective parts. For warranty claims relating to Excluded Products, customer shall rely solely and exclusively on the warranty issued by the manufacturer of such Excluded Product, if any.

Limitation of Liability and Indemnity: Customer assumes all liability and risk arising from the ordering, purchase, use or installation of parts that are purchased from TUNINGPARTS. TUNINGPARTS shall not be liable for any damages to any person or property arising out of or in connection with the use or installation of any parts that it sells. Customer agrees to indemnify TUNINGPARTS from any and all claims (including legal fees) arising out of or in connection with the use or installation of the product(s) it purchased from TUNINGPARTS. TUNINGPARTS is not responsible for any damages or claims arising out of a delay in the processing or shipment of any order. By purchasing products from TUNINGPARTS, Customer is acknowledging that it agrees to accept this Limitation of Liability and these Terms and Conditions.

Merchandise: We sell new parts for SMART automobiles. Please note that product descriptions and photographs used on our online catalog are examples only. Actual item may differ.

The Customer shall inspect and accept or reject acceptance of the Terms and Conditions of this sale immediately upon the arrival of the shipment, and shall, within three (3) working days after arrival of any shipment, give written notice to TUNINGPARTS of any claim that the Terms and Conditions set forth herein are not acceptable. The Customer expressly waives any right the Customer may have to revoke acceptance after such three-day period.

Applicability: These Terms and Conditions are applicable to all order placed by the customer, whether online on our website or by telephone, including all future orders.
